Terms of Service

These terms govern use of Ematrix WhatsApp Cloud, operated by Ematrix Institute of I.T. ("Ematrix", "we"). By using the dashboard or API you agree to them on behalf of your organization.

1. The service

Ematrix WhatsApp Cloud lets businesses send and receive WhatsApp messages through the official WhatsApp Business Platform (Cloud API). WhatsApp messaging is provided by Meta; your use of WhatsApp is also subject to the WhatsApp Business Messaging Policy and Meta's terms.

2. Your responsibilities

  • Obtain valid opt-in consent before sending marketing messages, and honour opt-outs promptly.
  • Send only lawful content, and only content permitted by WhatsApp policies.
  • Do not send sensitive data such as health records, payment card numbers or passwords in message content.
  • Keep your API keys, passwords and Meta credentials confidential, and notify us of any suspected compromise.
  • Ensure you have a lawful basis to process the personal data of the people you message.

3. Acceptable use

You may not use the service for spam, fraud, harassment, unsolicited bulk messaging, or to circumvent WhatsApp or Meta limits. We may suspend accounts that put recipients, the platform, or our WhatsApp standing at risk.

4. Fees and limits

Plan fees and usage limits are agreed with Ematrix. WhatsApp conversation or message charges are set by Meta and billed to the WhatsApp Business Account owner unless agreed otherwise.

5. Availability

We work to keep the service available and secure but do not guarantee uninterrupted operation. Message delivery also depends on Meta, mobile networks and recipient devices.

6. Data protection

Our handling of personal data is described in our Privacy Policy. For recipient data, you are responsible for how and why it is processed, and we process it on your instructions.

7. Liability

To the extent permitted by law, Ematrix is not liable for indirect or consequential losses, or for losses caused by Meta, WhatsApp, network operators, or your misuse of the service.

8. Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these terms. On termination you may request export or deletion of your data.

9. Governing law

These terms are governed by the laws of India. Courts at Srinagar, Jammu & Kashmir have jurisdiction.
